Terms and Conditions

 

These Terms and Conditions govern your access to and use of the FlyIQ by DIWA website and training services. By using our website or enrolling in our courses, you agree to comply with and be bound by these Terms. Please read them carefully before proceeding.

 

1. General Conditions

FlyIQ by DIWA reserves the right to update or change these Terms at any time with reasonable notice. Your continued use of the website or participation in courses following any changes indicates your acceptance of the revised Terms. It is your responsibility to check this page periodically for updates.

2. Course Information and Booking

We make every effort to ensure that all course descriptions, content, schedules, and pricing are accurate and up to date. However, we do not warrant that course information is error-free. All courses are subject to availability, and we reserve the right to modify course content, reschedule, or cancel courses due to insufficient enrolment, instructor availability, regulatory requirements, or other operational needs. Where possible, we will provide a minimum of 48 hours’ notice of any changes.

Where FlyIQ by DIWA cancels or reschedules a course, students will be offered, at their choice: (a) transfer to the next available course date at no additional cost, or (b) a full refund of fees paid for the cancelled course.

3. Pricing and Payments

All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated. We accept secure payment via major credit cards and other methods listed at checkout. Full payment is required to secure your course enrolment unless alternative arrangements have been agreed in writing.

​3.1 Late Payment Fees

If any fees are not paid by the invoice due date, a late payment fee of 5% of the outstanding balance will apply. If it becomes necessary to engage a debt collection agency, all associated recovery costs will be added to the outstanding balance.

​

4. Student Support Commitment​

DIWA is committed to helping every student achieve their Remote Pilot Licence or advanced training outcome. To support this, DIWA provides:

  • Experienced CASA-certified instructors;

  • Access to online learning materials and practice tests;

  • Additional mentoring or revision support where needed; and

  • Options to rebook assessments at discounted rates if further attempts are required.​

​

Certification is issued by CASA and subject to CASA standards. While DIWA cannot guarantee outcomes, we will make every reasonable effort to prepare students for success.

​

4.1 Performance Guarantee

​If a student does not pass their CASA assessment on the first attempt, the following applies: -

 

  • Where the retest can be scheduled into an already-running course, the retest is provided free of charge. 

  • Where no course is currently running and a dedicated session is required, a fee will apply to cover the cost of the instructor and assessor.

  • Students are entitled to up to three (3) attempts at the assessment under this policy. If a student does not pass within three attempts, they will be required to re-enrol in and complete the full course before further assessment attempts.

  • To be eligible, the student must have attended all scheduled training sessions and completed all required coursework in good faith.

  • Claims must be made within 7 days of the original assessment result.

The Performance Guarantee does not cover CASA examination fees, which remain payable separately by the student. This guarantee is offered at FlyIQ by DIWA's discretion and does not constitute a promise of certification, which remains subject to CASA's sole determination.

5. Cancellations, Withdrawals, and Substitutions

5.1 Student Cancellations
  • More than 14 days before the course start: Full refund minus 10% administration fee.

  • 7–14 days before course start: 50% refund.

  • Less than 7 days before course start: No refund. Students who commence the course remain eligible for the Performance Guarantee (see Section 4.1).​

5.2 Course Rescheduling

Courses may be rescheduled due to operational, weather, or instructor factors. Students will be transferred to the next available course at no extra charge. If unsuitable, alternative dates will be offered.

5.3 Substitutions
  • Substitutions are allowed only for exceptional circumstances (e.g. medical emergency, bereavement).

  • Substitutes must meet all prerequisites and complete the entire remaining course.

  • Administration fees and additional training costs may apply depending on course progress at the time of substitution.

5.4 Emergency Withdrawals

Documented emergencies will be considered on a case-by-case basis, and alternative arrangements may be offered at our discretion.

6. Liability and Warranties

6.1 Training Warranties

FlyIQ by DIWA warrants that training will be delivered by qualified instructors in line with CASA requirements and current industry standards. We do not guarantee:

  • Employment or career outcomes.

  • Certification body decisions or regulatory changes.

  • Learning outcomes beyond the scope of our structured program.

6.2 Limitation of Liability

Our total liability is limited to the amount paid for the relevant course. We are not liable for:

  • Indirect or consequential losses.

  • Loss of income, business opportunities, or employment.

  • Injuries outside our direct supervision during training.

​

6.3 Student Responsibilities

Students are responsible for:

  • Meeting CASA or other certification body requirements beyond course completion.

  • Maintaining currency of qualifications after training.

  • Complying with aviation regulations and medical/legal obligations for drone operations.

​

7. Intellectual Property and Course Materials

All course materials remain the intellectual property of FlyIQ by DIWA. Materials are for personal study only and must not be copied, distributed, or used commercially without permission. Login credentials are individual-use only and must not be shared.

​

8. Conduct and Safety

Students must:

  • Act lawfully and respectfully during training.

  • Comply with safety instructions and site rules.

  • Refrain from behaviour that may disrupt training or compromise safety.

Violations may result in dismissal from the course without refund.

​

9. Privacy and Data Protection

DIWA collects and stores personal information in accordance with the Privacy Act 1988 (Cth). Information may be shared with CASA or other regulatory bodies where required for certification.

​

10. External Resources Disclaimer

FlyIQ by DIWA is not responsible for the content of third-party resources linked from our website. Users should seek independent advice where necessary.

​

11. Consumer Rights

These Terms do not limit your rights under Australian Consumer Law.

​

12. Dispute Resolution

We aim to resolve disputes through good-faith negotiation. Disputes not resolved will be subject to the exclusive jurisdiction of the courts in Western Australia.

​

13. Force Majeure

We are not liable for delays or failures caused by events beyond our control (including natural disasters, government restrictions, or public health emergencies).

​

14. Governing Law

These Terms are governed by the laws of Western Australia, Australia.
